1. About these terms

These Terms and Conditions ("Terms") govern your use of this website and any purchases you make through it. This site is operated by Calm and Collected Music Group, 4 Sweetgrass Rd, Westhampton, NY 11977, United

States ("we," "us," "our"). Chill Caterpillar is one of our record labels.

By using this site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to use this site or place an order. By placing an order you confirm you are legally capable of entering into binding contracts.

3. Changes to these terms

We may update these Terms from time to time. The version posted on this site at the time you place an order is the version that applies to that order. Continued use of the site after changes are posted means you accept the updated Terms.

4. Products and orders

Product descriptions. We try to describe and photograph our products accurately, but colors, finishes, and sizing may vary slightly from what appears on your screen.

Availability. All products are subject to availability. We may limit quantities, refuse or cancel any order, and discontinue products at any time.

Pricing. Prices are shown in US dollars and are exclusive of shipping and applicable taxes unless stated otherwise. If a product is listed at an incorrect price due to error, we may cancel the order and refund any amount paid.

Order acceptance. Your order is an offer to buy. A contract is formed only when we confirm that your order has shipped. An order confirmation email is not acceptance.

Payment. Payment is handled by our payment provider. We do not store full payment card details. You confirm that you are authorized to use the payment method you provide.

5. Shipping and delivery

Shipping options, costs, and estimated delivery times are shown at checkout. Delivery estimates are estimates only and are not guaranteed.

Risk of loss passes to you on delivery to the address you provide. You are responsible for giving us an accurate shipping address, and we are not liable for items lost because an incorrect address was supplied.

If you are ordering from outside the United States, you are responsible for any customs duties, import taxes, or fees charged by the destination country. These are not included in the price you pay us.

6. Returns, exchanges, and damaged items

If something arrives damaged or defective, contact us at info@chillcaterpillar.com with your order number and photographs, and we will arrange a replacement or refund.

For all other return and exchange requests, contact us at info@chillcaterpillar.com and we will let you know how to proceed. Refunds are issued to the original payment method.

Depending on where you live, you may have additional statutory cancellation or refund rights, and nothing in these Terms removes them.

7. Music and digital content

Any music, video, or other content we make available on or through this site is licensed to you for personal,

non-commercial use only. You may not reproduce, redistribute, resell, sample, remix, synchronize to video, or

publicly perform any of it without our prior written permission.

Nothing on this site grants you a license to use our recordings or compositions commercially, including in

videos, streams, or advertisements.

8. Intellectual property

All content on this site, including the Chill Caterpillar character, logos, artwork, illustrations, typography, photographs, text, sound recordings, and compositions, is owned by us or our licensors and is protected by copyright, trademark, and other laws.

You may not copy, modify, distribute, sell, or create derivative works from any of it without our prior written permission. Linking to the site and resharing our own social posts in the normal way is fine.

Chill Caterpillar, the Chill Caterpillar character, and the Chill Caterpillar logo are trademarks of Calm and Collected Music Group.

9. Things you send us

If you send us ideas, artwork, suggestions, or comments, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that material in connection with our business, without payment to you, unless we agree otherwise in writing.

Please do not send us confidential information, or material belonging to someone else.

10. Acceptable use

You agree not to: use this site for any unlawful purpose; attempt to gain unauthorized access to the site or any related systems; scrape, data-mine, or use automated systems to access the site, other than standard search engine indexing; introduce malware or otherwise interfere with how the site works; impersonate any person or misrepresent your affiliation with anyone; use our content to train machine learning or artificial intelligence models without our prior written permission.

11. Promotions, raffles, and giveaways

Any promotion, contest, raffle, or giveaway we run may be subject to additional rules, which will be published with that promotion. Where those rules conflict with these Terms, the promotion rules apply for that promotion.

12. Disclaimers

This site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted, secure, or error-free, or that any defects will be corrected.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of this site or any product purchased through it.

Our total liability arising out of or relating to these Terms or any order will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnity

You agree to indemnify and hold harmless Calm and Collected Music Group, its officers, employees, and agents from any claims, damages, losses, and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of this site.

15. Termination

We may suspend or end your access to this site at any time, without notice, if we reasonably believe you have breached these Terms.

16. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

Any dispute will be resolved in the state or federal courts located in New York, and you consent to the jurisdiction of those courts.

If you are a consumer outside the United States, you may have the right to bring proceedings in your local courts, and nothing here removes rights you have under mandatory local consumer law.

17. General

Severability. If any provision is found unenforceable, the rest remains in effect.

No waiver. If we do not enforce a provision, that is not a waiver of it.

Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding this site.

Assignment. You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.
